the Authority has prepared the document which includes guidelines, general provisions, criteria, and requirements related to qualifying technical companies to provide services in the field of digital government on behalf of government agencies, to ensure access to a comprehensive document for systematic and fair qualification of technical companies wishing to practice digital government activities and the government agency responsible for digital projects that use the revenue-sharing model.

1. Introduction

The Digital Government Authority is aware of the importance of approving regulations that would keep pace with current and future requirements, to contribute mainly to enhancing digital performance within government agencies, raising the quality of services provided and improving the experience of the beneficiary of such services, in line with the ambitious Saudi Vision 2030. The strategic directions of digital government emphasize the importance of adopting digital regulations by providing an effective and flexible regulatory environment that adapts to future changes, in order to pave the way for government agencies to provide digital government services of high quality and efficiency that contribute to raising investment returns and the value of the national economy. 

With reference to the Government Tenders and Procurement Law issued by Royal Decree No. (M/128) dated 13/11/1440H and its Implementing Regulations, Royal Decree No. (M/33) issued on 13/04/1443H regarding allowing government agencies to use revenue-sharing, and Resolution No. (1877) dated 24/12/1443H of His Excellency the Minister of Finance approving the Revenue Sharing Rules. The Authority shall be the competent agency in all matters pertaining to digital government. It shall be deemed the national reference in its affairs. Based on the powers vested in the Digital Government Authority under its Statute issued by Council of Ministers Resolution No. (418) dated 25/1442H, which includes qualification and licensing to provide digital trust and identity services, and digital government services, and it aims to organize digital government activities  in government agencies in order to establish a proactive digital government capable of providing highly efficient digital services, and achieving integration in the field of digital government among all government agencies, the Authority has prepared the document titled “Standards and procedures for qualifying to engage in digital government work through the revenue-sharing model”, which includes guidelines, general provisions, criteria, and requirements related to qualifying technical companies to provide services in the field of digital government on behalf of government agencies, to ensure access to a comprehensive document for systematic and fair qualification of technical companies wishing to practice digital government activities  and the government agency responsible for digital projects that use the revenue-sharing model.

This document is subject to periodic review by the Authority. Moreover, the Authority has the absolute right to modify, add, or delete any part of these criteria and procedures.

2. Objectives

This document aims to regulate the most important aspects related to the provision of services in the field of digital government by technical companies on behalf of government agencies, in order to achieve the following:

  1. Strengthening cooperation between government agencies and technical companies in digital projects according to the revenue-sharing model.

  2. Promoting innovation in digital government platforms and services by providing a fair competitive environment.

  3. Advancing the maturity of digital government services and enhancing the economic impact resulting from companies’ participation in digital government activities.

  4. Enabling small and medium enterprises and providing them with the opportunity to provide digital government work.

3. Scope

The Authority prepared this document to establish the standards and procedures for practicing digital government activities and the government agencies responsible for the platforms/services on the basis of the revenue sharing model, as follows:

  • The categories of qualification for practicing digital government activities are divided into three main categories.

  • Criteria for applying for qualification aims to determine the preconditions for submitting a qualification application.

  • The necessary procedures to obtain qualifications are as follows:

  1. Submission of Application

  2. Application examination mechanism

  3. Issuance mechanism

  4. Renewal mechanism

  • Qualification duration.

  • Financial fees for qualifying companies to practice digital government activities.

  • Obligations of the Qualified person.

  • General provisions. 

4. Principles

The Authority followed (6) six principles in developing the criteria and procedures in order to ensure reaching a comprehensive framework for systematic and fair qualification of the qualified person and the government agency responsible for digital projects that use the revenue-sharing model.

  • 4.1 Competition: Enabling fair competition for all companies and promoting the growth of their services inside and outside Saudi Arabia, while providing the opportunity for small and medium enterprises to provide digital government activities.

  • 4.2 Transparency: Ensuring clarity and transparency between the qualified person and the government agency in the various stages of competitions and projects.

  • 4.3 Alignment: Ensuring alignment with existing initiatives in the Authority and other government agencies to determine aspects of cooperation between government sectors in digital projects that use the revenue-sharing model.4.4 Ambition: Supporting national efforts to maximize revenues generated from digital projects and develop digital capabilities in the public and private sectors.

  • 4.5 Flexibility: Adopting organizational flexibility to adapt to market fluctuations.

  • 4.6 Beneficiary experience: Improving the experience of beneficiaries of digital government services and enhancing their quality.

5. Applicability

This document applies to:

Any qualified person that provides digital government activities on behalf of government agencies using the revenue-sharing model.
Any obligations resulting from this document will be binding unless the Authority decides, according to its regulation, the instructions issued by it, and the requirements of the public interest, to exclude or modify any paragraph in this document.

The following terms and expressions - wherever they appear in this document - shall have the meanings indicated on the opposite side of each of them, unless the context requires otherwise.

Authority Digital Government Authority.
Statute Statute of the Digital Government Authority issued by Council of Ministers Resolution No. (418) dated 25/07/1442H, and any modifications to it.
Digital Transformation The strategic reorganization of businesses based on data, information technology, and telecommunications networks.
Digital Government Supporting administrative, organizational and operational processes within, and across government sectors; to achieve digital transformation and to develop, improve and provide easy and effective access to government information and services.

Digital Government Activities Developing or operating government platforms and services on behalf of the government agency.
Qualification for Digital Government Activities A document issued by the Authority to a legal person proving that it has met the requirements and conditions determined by the Authority to provide services in the field of digital government activities according to the category specified for it.
Revenue-sharing A type of contract, under the provisions of the Government Tenders and Procurement Law and its executive regulations, between a government agency and a private partner to provide goods and services to provide public services to beneficiaries based on the division and distribution of revenue between the parties to the contract. Under such contract, the private partner assumes management risks and responsibilities throughout the contract term in accordance with the definition contained in the rules.
Asset Every asset, whether permanent or temporary, immovable or movable, tangible or intangible, including rights according to the definition contained in the rules.
Qualified Person A legal person who holds a qualification document to provide digital government work.
Digital Platform The technical solutions on which digital products and services are built, that provide beneficiaries with an enhanced digital experience through digital portals or smart device applications (digital channels). The digital platform allows these channels to connect and integrate with each other. The digital platform allows the integration of its services with other external services, such as: Absher platform.
Digital Service A set of digital actions that are linked to each other to perform a complete function provided by a government agency to the beneficiary through digital channels, such as: portals and smart device applications, which have one main and identifiable output. A group of services can be linked to each other to form a digital product, such as: passport issuance, passport renewal, driving license renewal, traffic violation inquiry, and national ID renewal.
Digital Platform Development All activities that include all requirements related to the platform and its services, as well as the design and technical development solutions, announcement, and performance of the necessary tests to ensure their quality in accordance with the criteria and regulations issued by the relevant authorities.
Digital Platform Operation This includes providing platform services on behalf of the government agency responsible for it, and managing the digital platform to ensure its performance and continuity of operation in accordance with the specific service level agreements.
Acting on behalf of the government agency Performing a role or task or more, of the digital roles or tasks assigned to a government agency under a legal instrument on the basis of the revenue-sharing contract model.
